The Court of Appeal granted permission for the case to proceed on two grounds concerning:

1. The failure to provide adequate or effective information to the public about the risks and how, if it be possible, it might be possible for individuals to avoid or minimise the risks;

2. (a) The failure to provide adequate and sufficient reasons for not establishing a process to investigate and establish the adverse health effects and risks of adverse health effects from 5G technology and/or for discounting the risks presented by the evidence available; and/or (b) failure to meet the requirements of transparency and openness required of a public body.

These grounds advance a breach of the Human Rights Act 1998 by omissions and failings in violation of the positive obligations to protect human life, health and dignity, required to be met by Articles 2, 3 and/or 8 of the European Convention on Human Rights.

Planning rules for 5G masts in England Dec 2022

“Councils should consider material planning considerations (MPC) under the Town and Council Planning Act. Any health objections can be used as evidence of incompatibility, in the weighing up of the MPC of ‘unacceptable and incompatible use of land’, counter to the ICNIRP compliance certificate also submitted. We are delighted to inform you that the 15 metre monopole mast application by St Peters Community Primary and Nursery School, Portslade has just been REFUSED by Brighton & Hove City Council. 

Two more of the 5G Street Hubs intended for Cheltenham have been dismissed at the appeals stage, by the Planning Inspectorate: 22/00024/ADV1 and 22/00019/ADV1. The status on these now is that out of the nine applications, two were refused planning permission and not appealed, six have had their appeals dismissed, leaving one remaining at the appeals stage.

We do hear reports that the Inspectorate are certainly not siding unduly with the Telco claimants, and are possibly understanding the health aspects, though are not on record about this yet as such.

UK Action Against 5G: hearing 13.12.2022. Michael Mansfield KC had a small accident that morning and so was admitted to A+E instead of the Bench. A motion for adjournment was accepted and the case has been re-scheduled for February 2023. This gives the team extra time to converse, gather and collate more evidence and refine arguments, which cannot be a bad thing.

Children’s Health Defense is seeking plaintiffs for lawsuits challenging WiFi in schools, and cell towers and small cells in residential areas in an effort to protect children and other vulnerable populations from harmful levels of radiofrequency radiation exposure.
